1. Introduction

Welcome to TellMe.Health (“TellMe,” “we,” “our,” or “us”), a teletherapy platform operated by TellMe.Health, a subsidiary of TellMe, A Professional Licensed Clinical Social Worker Corporation. TellMe.Health connects clients with licensed therapists who lead with experience, integrity, and humanity.

These Terms and Conditions (“Terms”) govern your access to and use of our website at https://www.tellme.health and all related applications, communication tools, and digital services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which describes how we collect and protect your information. If you do not agree, please do not use our Services.

2. Purpose of Services

TellMe.Health provides access to licensed mental health professionals through secure teletherapy sessions and related digital resources. Our Services are designed to make professional therapy accessible, compassionate, and secure — but they are not a substitute for emergency care.

If you are in crisis or believe you may harm yourself or others, call 911, 988 (Suicide and Crisis Lifeline), or go to your nearest emergency room immediately.

3. Eligibility

You must be at least 18 years old (or the age of majority in your state) to use TellMe.Health. By using our Services, you represent that:
– You meet this age requirement.
– The information you provide is accurate and truthful.
– You are physically located in a state where your therapist is licensed to practice.

4. Informed Consent for Telehealth

By using TellMe.Health, you provide your informed consent to receive therapy via telehealth.

You understand and agree that:
– Telehealth involves the use of secure video, audio, and digital communication tools.
– Potential benefits include greater accessibility, scheduling convenience, and comfort.
– Potential risks include technology interruptions, limited nonverbal cues, or data breaches despite encryption safeguards.
– You may withdraw consent for teletherapy at any time by notifying your therapist or TellMe.Health in writing.
– Each therapist is independently licensed and solely responsible for the clinical services they provide.

5. Therapist Independence and Professional Judgment

All clinical services are delivered by licensed therapists who are independent professionals and not employees or agents of TellMe.Health.

TellMe.Health provides the technology platform, scheduling, and support, but does not supervise, control, or interfere with therapists’ professional judgment. Your therapist is solely responsible for your assessment, diagnosis, treatment, and care decisions.

6. User Accounts

To access teletherapy services, you may need to create an account. You agree to:
– Provide accurate, complete, and current information.
– Maintain the confidentiality of your login credentials.
– Notify us immediately of any unauthorized use or suspected security breach.

TellMe.Health reserves the right to suspend or terminate your account for any violation of these Terms or for security reasons.

7. Payments and Fees

You agree to pay all applicable fees for the Services you purchase or subscribe to.
– Fees and payment terms are presented before checkout or as part of your service agreement.
– Payments are processed securely through third-party providers; TellMe.Health does not store your credit card or payment data.
– Unless required by law, all payments are non-refundable once services are rendered.
– If you use insurance, your coverage, co-pay, and benefits are determined by your plan and provider, not by TellMe.Health.

8. Privacy and Confidentiality

Your privacy is our priority. TellMe.Health complies with the Health Insurance Portability and Accountability Act (HIPAA) and all applicable federal and state privacy laws.

Our Privacy Policy explains how we collect, use, store, and protect your personal and health information. We use encryption and secure technology to safeguard data, but we cannot guarantee absolute security of transmissions over the internet.

Your therapist may disclose information only as permitted or required by law (for example, if there is a risk of harm to yourself or others, or in cases of abuse reporting).

9. Acceptable Use

You agree not to use the Services to:
– Violate any applicable law or regulation.
– Impersonate another person or misrepresent your identity.
– Harass, threaten, or abuse therapists, staff, or other users.
– Interfere with or disrupt the platform or its servers.

TellMe.Health may suspend or terminate access if these rules are violated.

10. Intellectual Property

All content on the TellMe.Health website and platform — including text, graphics, designs, trademarks, and logos — is the property of TellMe.Health or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, or reproduce any materials without our prior written consent.

11. Disclaimers

The Services and all related content are provided “as is” and “as available.” TellMe.Health makes no warranties, express or implied, regarding:
– The accuracy, reliability, or completeness of information on the platform.
– The outcomes or results of therapy.
– Uninterrupted or error-free service operation.
Your use of the Services is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, TellMe.Health, its parent company, affiliates, officers, and employees are not liable for any indirect, incidental, consequential, or special damages arising from your use of or inability to use the Services — including lost data, lost profits, or emotional distress.

13. Indemnification

You agree to indemnify and hold harmless TellMe.Health, its parent company, subsidiaries, officers, employees, and therapists from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.

14. Termination

TellMe.Health may suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. Upon termination, your right to use the Services will immediately cease, except for any obligations that survive termination (such as confidentiality, payment, and indemnity).

15. Governing Law and Arbitration

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute or claim arising under these Terms will be resolved through binding arbitration administered by JAMS under its applicable rules. You agree to waive the right to a jury trial or to participate in any class-action lawsuit. Judgment on the arbitration award may be entered in any court of competent jurisdiction in California.

16. Changes to Terms

We may modify these Terms from time to time. The revised version will be posted on this page with an updated date. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.
